1993 LAWS OF MARYLAND

(c)     The Department OR A LOCAL AUTHORITY may issue a stop work order
against any person who violates any provision of this subtitle or any regulation, order,
approved plan, or management agreement.

(d)     (1) A person who violates any provision of this subtitle or any regulation,
order, plan, or management agreement under this subtitle is liable for a penalty not
exceeding $1,000 which may be recovered in a civil action brought by the Department OR
A LOCAL AUTHORITY. Each day a violation continues is a separate violation under this
subtitle.

(2) The court may issue an injunction requiring the person to cease the
violation and take corrective action to restore or reforest an area.

SECTION 2. AND BE IT FURTHER ENACTED, That:

(1)     In this section, "Forest Conservation Act" means Title 5, Subtitle 16 of the
Natural Resources Article, as enacted by Chapter 255 of the Acts of the General
Assembly of 1991.

(2)     There is an Advisory Group on Forest Conservation that shall serve through
May 31, 1994, and shall be composed of the following 11 members appointed by the
Governor as follows:

(i) 4 members recommended by the Secretary of Natural Resources, of
whom 2 shall be employed' by the Department of Natural Resources and represent the
Secretary, 1 shall represent environmental interests in the State, and 1 shall be a
practicing qualified and approved professional under the Forest Conservation Act;

(ii) 3 members recommended by the Maryland Association of Counties and
by the Maryland Municipal League;

(iii) 1 member recommended by the Chesapeake Bay Foundation;

(iv) 1 member recommended by the Maryland Chapter of the American
Planning Association;

(v) 1 member recommended by the Maryland Builders Association; and

(vi) 1 member recommended by the Maryland Farm Bureau.

(3)     The Governor shall appoint the Chairman of the Advisory Group from among
the members.

(4)     The Secretary shall provide sufficient and appropriate staff to the Advisory
Group to enable the fulfillment of its responsibilities.

(5)     The Advisory Group:

(i) Shall discuss, review, and attempt to resolve administrative and
procedural issues relating to the Forest Conservation Act; and

(ii) By December 1, 1993, shall review the Forest Conservation Act and,
subject to § 2-1312 of the State Government Article, may make recommendations to the
General Assembly and the Governor for modifications of the Forest Conservation Act
