Ch. 481                                     1993 LAWS OF MARYLAND

(II) [For] THE CLASS B-BWL (H-M) LICENSE SHALL BE ISSUED TO
any hotel or motel meeting the minimum criteria of [paragraph (3) of this subsection,
there shall be issued a special Class B license known as a Class B-BWL (H-M), for which
the] SUBPARAGRAPH (IV) OF THIS PARAGRAPH.

                   (III) THE annual license fee is $5,000.

[(3)](IV) [In Baltimore City the] THE minimum criteria for the issuance of
a Class B-BWL (H-M) license are as follows:

[(i)] 1. The hotel or motel shall contain no less than 100 rooms for
the accommodation of the public[.];

[(ii)]2. The hotel or motel shall contain a dining room with facilities
for preparing and serving regular meals for at least 125 persons at one seating [.]; AND

[(iii)]3. The capital investment in the hotel or motel facility may not.
be less than $500,000.

[(iv)] (V) A Class B-BWL (H-M) license may not be required of any
restaurant that is not located in a hotel or motel or of any catering establishment.

                                       [(4)](3) (i) 1. In this paragraph THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

2. "ARENA" MEANS A FACILITY THAT IS A:

A.      CATERING HALL;

B.     BANQUET HALL;

                        C.      AUDITORIUM;

D.      THEATRE;

E.      ATHLETIC FACILITY;

            F.      CONCERT FACILITY;

G.      STADIUM.

3.        "BOARD" MEANS THE BOARD OF LICENSE
COMMISSIONERS.

4.        ["person"] "PERSON" means a natural person, an
association, a firm, a partnership, a corporation, or the Mayor and City Council of
Baltimore.

(ii) THERE IS AN ARENA LICENSE.

(III) [In Baltimore City, for any stadium, convention hall, or other
arena, the Board of License Commissioners is authorized to approve the issuance of a
special Class B beer, wine and liquor license, to be known as an "arena license", for the
sale of] A LICENSEE MAY SELL beer, wine and liquor by the drink and by the bottle
within the arena, from one or more outlets, for consumption on the licensed premises.
