requirements for inspection, maintenance, and repair of certain dump service
vehicles; establishing a Dump Truck Technical Task Force and providing for the
duties, membership, procedures, and staffing of the Task Force; requiring the Task
Force to submit a certain report to the Department of Transportation by a certain
date; making certain provisions of this Act contingent on the enactment of certain
federal authorizing legislation; authorizing the Department to propose and adopt
certain regulations according to a certain schedule; providing for the termination of
certain provisions of this Act if Congress fails to enact certain legislation or the
Department fails to adopt certain regulations within a certain time; providing for
the construction of this Act: providing for a delayed effective date for certain
provisions of this Act; permitting certain types of vehicles to travel a certain
distance until a certain date; making stylistic changes; clarifying language; and
generally relating to the operation and registration of dump service vehicles.

Preamble
WHEREAS, The State of Maryland and interested and affected parties have been
working together to produce a workable method to reduce damage to the State's highway
and bridge system that results from dump service vehicles; and
WHEREAS, Designing four-axle vehicle configurations that provide for a
maximum gross vehicle weight of 70,000 pounds and specify axle spacing and maximum
axle weights will help to achieve a, reduction in highway damage while improving motor
vehicle safety and efficiency; and
WHEREAS, The State of Maryland and the interested and affected parties
including truck manufacturers, truck body manufacturers, and representative segments of
industry will work cooperatively to develop alternative vehicle design configurations; and
WHEREAS, The State of Maryland and the interested and affected parties agree
that any measures implemented under this Act to reduce highway damage shall be
sensitive to their overall economic impact and to their potential adverse impact on
business competition; and
WHEREAS, In Section 1023 of the federal Intermodal Surface Transportation
Efficiency Act of 1991, the Congress of the United States established specific
requirements applicable to specialized hauling vehicles operating on Interstate 68 in
Garrett and Allegany Counties in Maryland; and
WHEREAS, Any corrective measures provided by this Act will have no force and
effect unless appropriate federal legislation is enacted to authorize the measures; and
