AN ACT concerning
Consumer Mercuric Oxide Batteries - Prohibition of Sale or Distribution
FOR the purpose of prohibiting the sale, distribution, or offering for sale of consumer
mercuric oxide batteries under certain circumstances; defining certain terms;
providing for a delayed effective date; and generally relating to a prohibition of the
sale, distribution, or offering for sale of consumer mercuric oxide batteries.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(B) "CONSUMER MERCURIC OXIDE BATTERY" MEANS A BUTTON SHAPED OR
COIN SHAPED NONRECHARGEABLE BATTERY CONTAINING MORE THAN 25
MILLIGRAMS OF MERCURY THAT IS DESIGNED FOR RETAIL SALE AND USE IN THE
PERSONAL PRODUCTS OR HOUSEHOLD MARKET.
(C) (1) "MERCURIC OXIDE BATTERY" MEANS A DRY CELL BATTERY THAT
USES A MERCURIC OXIDE ELECTRODE THAT IS DESIGNED OR SOLD FOR
COMMERCIAL, INDUSTRIAL, MEDICAL, MILITARY, OR INSTITUTIONAL USE.
