(5) Prior to the payment of any funds under the provisions of this Act for the
purposes set forth in Section 1(3) above, the Board of Directors of the Maryland Food
Committee, Inc. shall provide and expend a matching fund. No part of an applicant's
matching fund may be provided, either directly or indirectly, from funds of the State,
whether appropriated or unappropriated. No part of the fund may consist of real
property, in kind contributions, or funds expended prior to the effective date of this Act.
In case of any dispute as to the amount of the matching fund or what money or assets may
qualify as matching funds, the Board of Public Works shall determine the matter and the
Board's decision is final. The Board of Directors of the Maryland Food Committee, Inc.
has until June 1, 1995, to present evidence satisfactory to the Board of Public Works that
a matching fund will be provided. If satisfactory evidence is presented, the Board shall
certify this fact and the amount of the matching fund to the State Treasurer, and the
proceeds of the loan equal to the amount of the matching fund shall be expended for the
purposes provided in this Act. Any amount of the loan in excess of the amount of the
matching fund certified by the Board of Public Works shall be canceled and be of no
further effect.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1993.

AN ACT concerning
Medical Assistance—Institutionalized Individuals—Lien on Real Property
Maryland Medical Assistance Program - Long-Term Care Benefits - Escheat Funds
FOR the purpose of requiring the Department of Health and Mental Hygiene to impose
a lien on the real property of certain institutionalized individuals under certain
circumstances for the purpose of recovering certain Medical Assistance payments;
authorizing the Department to seek an adjustment or recovery of certain Medical
Assistance payments from the sale of the real property subject to the lien under
certain circumstances; specifying that any lien imposed under this Act shall dissolve
under certain circumstances; requiring the Department to use any moneys collected
under this Act for certain purposes; requiring the Department to apply for and
receive a certain waiver from the Department of Health and Human Services prior
to implementing the provisions of this Act; and generally relating to requiring the
Department to impose a lien on the real property of certain institutionalized
individuals under certain circumstances for the purpose of recovering Medical
Assistance payments that the net estate proceeds of certain recipients of long-term
care benefits be paid to the Department of Health and Mental Hygiene for the
administration of the Maryland Medical Assistance Program under certain
circumstances; establishing the payment of the net estate proceeds to certain boards
of education for the use of local public schools as an alternative under a certain
