AN ACT concerning

Health Maintenance Organizations - Pharmaceutical Services

FOR the purpose of requiring health maintenance organizations and their agents that
propose to offer pharmaceutical services or propose to change the manner of
payment for pharmaceutical services that are currently provided by certain
providers to provide a certain written notice, certain offer, and certain opportunity
to all pharmacies in the area served by the health maintenance organization certain
notification to a certain association under certain circumstances; prohibiting a certain
fee; allowing the Maryland Pharmacists Association to distribute certain information;
providing for a certain exemption; and generally relating to health maintenance
organizations and pharmaceutical services.

(A)     IN THIS SECTION, "HEALTH MAINTENANCE ORGANIZATION" OR "HMO"
INCLUDES ANY AGENT OF A HEALTH MAINTENANCE ORGANIZATION.

(B)     A HEALTH MAINTENANCE ORGANIZATION THAT PROPOSES TO OFFER
PHARMACEUTICAL SERVICES OR PROPOSES TO CHANGE THE MANNER OF PAYMENT
FOR PHARMACEUTICAL SERVICES THAT ARE CURRENTLY PROVIDED BY ONE OR
MORE PROVIDERS SELECTED BY THE HMO SHALL:
