SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993, and shall be applicable to the estates of persons who die on or after
October 1, 1993.

AN ACT concerning
State Facilities - Change in Use, Purpose, or Function - Notice
FOR the purpose of prohibiting principal departments of the Executive Branch of State
government from changing the use, purpose, or function of certain State facilities
without giving certain notice and holding a public hearing; requiring principal
departments to hold certain hearings and to provide certain notice under certain
circumstances requiring a principal department to give certain notice before it
leases or purchases land, buildings, or office space for certain purposes; authorizing
a member of the General Assembly to request a principal department to hold a
public hearing under certain circumstances; requiring a principal department to
hold a public hearing on the request of a member of the General Assembly under
certain circumstances and give certain notice of the hearing; requiring a principal
department to hold a public hearing and give certain notice of the hearing if it plans
to recommence operation of a State facility under certain circumstances; defining
certain terms; and generally relating to the requirement that principal departments
provide notice of changes in the use, purpose, or function of State facilities.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANING
INDICATED.
(2) (I) "CHANGE THE USE, PURPOSE, OR FUNCTION" MEANS AN
ABRUPT AND MATERIAL CHANGE IN THE TYPE OF CLIENTS OR INMATES SERVED IN
A FACILITY, THE LICENSED PURPOSE OF A FACILITY, OR THE PRINCIPAL ACTIVITIES
CARRIED OUT WITHIN A FACILITY.
