SECTION 3. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall
take effect July 1, 1993, contingent on the taking effect of Chapter______(H.B. 1359) of the
Acts of the General Assembly of 1993 and, if Chapter ___(H.B. 1359) does not become
effective, Section 2 of this Act shall be null and void without the necessity of further action by
the General Assembly.
SECTION 2. 4. AND BE IT FURTHER ENACTED, That, except as provided in
Section 3 of this Act, this Act shall take effect October 1, 1993.

Charitable Solicitation
FOR the purpose of altering a certain disclosure statement on charitable solicitations;
requiring charitable organizations claiming certain exemptions from registration to
provide certain evidence to the Secretary of State; providing that a charitable
organization that fails to submit certain evidence is not entitled to an exemption;
authorizing the Secretary of State to subpoena witnesses, administer oaths, examine
an individual under oath, and compel production of certain records under certain
circumstances; excluding the use of certain evidence from certain criminal
proceedings; altering certain fees to be paid by fund-raising counsel and
professional solicitors who engage certain other persons; repealing a certain
provision of law that provides application approval after certain inaction by the
Secretary of State; repealing certain provisions relating to hearings; altering the
levels of contributions at which a review and audit are required; altering the
registration statement for charitable organizations; repealing certain provisions
pertaining to denial of registration of charity, professional solicitor, and
fund-raising counsel; providing that a charitable organization claiming exemption
has a certain burden of production of evidence in certain proceedings; requiring
certain filings by certain exempt charities; requiring a certain attachment to
fund-raising agreements; prohibiting certain provisions in fund-raising agreements;
requiring a certain disclosure on certain solicitations; prohibiting intentional
solicitation of a person who has given a certain notice to a charitable organization;
prohibiting a person convicted of a theft related felony from certain roles in a
charitable organization or professional solicitor; altering certain prohibitions
applicable to professional solicitors, associate solicitors, and fund-raising counsel;
and generally relating to charitable solicitation, and registration of charitable
organizations, professional solicitors, associate solicitors, and fund-raising counsel.
