Ch. 372 1993 LAWS OF MARYLAND
(1) AN INDIVIDUAL LICENSED OR CERTIFIED UNDER THE HEALTH
OCCUPATIONS ARTICLE TO PROVIDE HEALTH CARE; OR.
(2) THE ADMINISTRATOR OF A HOSPITAL.
(N) (1) "HEALTH CARE PROVIDER" MEANS;
(I) A HEALTH CARE PRACTITIONER; OR
(II) A FACILITY THAT PROVIDES HEALTH CARE TO INDIVIDUALS,
INCLUDING:
1. AN ENTITY LICENSED UNDER TITLE 17, SUBTITLE 2, 3, OR 4,
OF THIS ARTICLE;
2. AN ENTITY LICENSED UNDER TITLE 19, SUBTITLE 3, 3A, 4,
5, 7, 9, 11, OR 12 OF THIS ARTICLE; OR
3. AN OUTPATIENT CLINIC.
(2) "HEALTH CARE PROVIDER" INCLUDES AN AGENT OR EMPLOYEE OF
A HEALTH CARE PROVIDER.
(O) "INCAPACITATED" MEANS AN INABILITY, BY REASON OF A PHYSICAL OR
MENTAL IMPAIRMENT, ILLNESS, OR OTHER MEDICAL CONDITION, TO:
(1) RECEIVE AND EVALUATE HEALTH CARE INFORMATION;
(2) MAKE AND COMMUNICATE DECISIONS BASED ON THAT
INFORMATION; AND
(3) UNDERSTAND THE IMPLICATIONS OF THESE DECISIONS.
(P) "LIFE SUSTAINING PROCEDURE" MEANS ANY MEDICAL PROCEDURE,
TREATMENT, OR INTERVENTION USED TO SUSTAIN, RESTORE, OR SUPPLANT A
SPONTANEOUS VITAL FUNCTION TO PREVENT OR POSTPONE THE DEATH OF AN
INDIVIDUAL.
(Q) "LIVING WILL", FORMERLY KNOWN AS A DECLARATION, MEANS A
DOCUMENT THAT IS EXECUTED UNDER SUBTITLE 4, PART II OF THIS TITLE.
(R) "MEDICALLY INEFFECTIVE" MEANS THAT, TO A REASONABLE DEGREE OF
MEDICAL PROBABILITY, A MEDICAL TREATMENT OR PROCEDURE WILL NOT;
(1) IMPROVE OR MAINTAIN THE HEALTH OF AN INDIVIDUAL;
(2) PREVENT OR REDUCE THE DETERIORATION OF THE HEALTH OF AN
INDIVIDUAL; OR
(3) PREVENT OR POSTPONE FOR MORE THAN AN INSIGNIFICANT
LENGTH OF TIME THE DEATH OF AN INDIVIDUAL.
(S) "PATIENT CARE ADVISORY COMMITTEE" MEANS AN ADVISORY
COMMITTEE ESTABLISHED UNDER TITLE 19, SUBTITLE 3 OF THIS ARTICLE.
