(3) SUBMIT A REPORT TO THE GOVERNOR AND, SUBJECT TO § 2-1312 OF
THE STATE GOVERNMENT ARTICLE, TO THE GENERAL ASSEMBLY ON THE
EFFECTIVENESS OF THE HOMELESSNESS PREVENTION PROGRAM IN PREVENTING
FAMILIES AND INDIVIDUALS FROM BECOMING HOMELESS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

AN ACT concerning

Nontidal Wetlands - Mitigation Banking

FOR the purpose of requiring the Department of Natural Resources to adopt standards
for the establishment of nontidal wetland mitigation banking projects; requiring the
Department to establish certain mitigation banking projects; specifying the use of
certain mitigation banking projects as a basis for certain wetland activities; requiring
the Department to require certain applicants to evaluate the applicability of
mitigation banking to certain development projects; specifying a certain
circumstance required for the Department's acceptance of monetary compensation
as wetland mitigation making certain declarations of the General Assembly on
wetland mitigation banking; requiring the Department of Natural Resources to
adopt certain standards and regulations on wetland mitigation banking, including
types and areas affected, construction methods, and maintenance and bonding
requirements; authorizing the use of the Nontidal Wetland Compensation Fund for
a mitigation banking project certain purposes relating to mitigation banking;
providing for a certain construction of this Act; requiring the Department to report
certain information to certain persons by a certain date; requiring the Department
to adopt certain regulations by a certain date; defining a certain term certain terms;
providing for the effective date of this Act; and generally relating to the
establishment and regulation of nontidal wetland mitigation banking projects.
