DRAFTER'S NOTE:

This section is new material that is intended to bring to one place all of the
provisions in Article 2B that specify the alcoholic content of light wine.

12 A.

[(b)](A) This [license may be issued] SECTION APPLIES only in Kent County.

[(a)](B) A Class A light wine license may be issued by the clerk of the circuit
court of the county in which the place of business is located. [, and shall authorize the
holder] IT AUTHORIZES THE LICENSEE to keep for sale, and to sell, light wines at retail,
in any quantity to any consumer, at the place described in the license. The light wine may
be delivered in a sealed package or container, which package or container may not be
opened or its contents consumed on the premises where sold. [No wine may contain
more than 14 percent alcoholic content by volume.]

(C) The annual LICENSE fee [for this license shall be] IS $150 and shall be
[payable] PAID to the Clerk[,] before any license is issued[, for distribution as provided
in this section].

DRAFTER'S NOTE:

This section is revised to correct two errors and to clarify language and structure.
The first error pertains to the percent alcohol content by volume of the wine; it
contradicts current § 2(c)(2). In a telephone conversation on January 22, 1993 with Janice
F. Fletcher, Administrative Assistant/Clerk to the Board of Liquor License
Commissioners of Kent County, it was verified that the 22 percent specified in current §
2(c)(2) is the correct amount.

The second error occurred in proposed subsection (c). Distribution is not provided
in this section of law and the statement is, therefore, proposed for repeal.

13.

(a)     A Class A beer and light wine license shall be issued by the clerk of the circuit
court of the county in which the place of business is located. The HOLDER OF THE
license [shall authorize the holder thereof to] MAY keep for sale[,] and [to] sell beer
and light wines at retail, in any quantity to any consumers, at the place [therein]
described IN THE LICENSE. [, and to] THE HOLDER SHALL deliver the [same] BEER
AND LIGHT WINES in a sealed package or container, which package or container [shall
not] MAY NOT be opened nor its contents consumed on the premises where sold. The
annual fee for the license shall be [$35 and shall be payable] PAID to the clerk[,] before
any license is issued, for distribution as [hereinafter] provided.

(b)     (1) In Allegany County the annual LICENSE fee [for such a license] is $100.

(2) The [said] package or container [shall not] MAY NOT be opened nor
its contents consumed on any premises in which the licensee [shall have] HAS any direct
or indirect interest.
