(House Bill 572)

AN ACT concerning

Carroll County - Massage Parlor Regulation - Authorization

FOR the purpose of authorizing the County Commissioners of Carroll County to adopt an
ordinance or regulations governing massage establishments; exempting certain
occupations and businesses; defining certain terms; and generally relating to the
authority of the County Commissioners to regulate the providing of massages for
compensation in Carroll County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 7 - Carroll County

7-4.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2)      "MASSAGE" MEANS ANY METHOD OF TREATING, FOR
COMPENSATION, THE EXTERNAL PARTS OF A HUMAN BODY BY TOUCHING,
RUBBING, STROKING, KNEADING, TAPPING, OR VIBRATING WITH THE HAND, ARM,
FOOT, MOUTH, OR OTHER BODY PART OR WITH ANY INSTRUMENT.

(3)      "MASSAGE ESTABLISHMENT" MEANS ANY ESTABLISHMENT DOING
BUSINESS IN CARROLL COUNTY WHERE MASSAGES ARE ADMINISTERED.

(4)     "MASSAGE THERAPIST" MEANS AN INDIVIDUAL WHO HAS:

(I) COMPLETED AT LEAST 500 HOURS OF TRAINING IN A SCHOOL
WHOSE CURRICULUM IS APPROVED BY A PROFESSIONAL ORGANIZATION THAT
CERTIFIES MASSAGE TRAINING PROGRAMS IF THE COUNTY COMMISSIONERS
RECOGNIZE THE ORGANIZATION;

(II) COMPLETED AT LEAST 250 HOURS OF TRAINING AND IS
CURRENTLY ENROLLED IN A SCHOOL WHOSE CURRICULUM IS APPROVED BY A
PROFESSIONAL ORGANIZATION THAT CERTIFIES MASSAGE TRAINING PROGRAMS IF
THE COUNTY COMMISSIONERS RECOGNIZE THE ORGANIZATION; OR

(III) PASSED THE NATIONAL CERTIFICATION EXAMINATION FOR
PROFESSIONAL MASSAGE AND BODYWORK.
