(2) Funds for the operation of the educational programs in State juvenile
residential institutions shall be provided in the budget of the Department of Juvenile
Services.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 8 of Chapter
3 of the Acts of the General Assembly of the Second Special Session of 1991, as amended
by Chapter 182 of the Acts of the General Assembly of 1992, be repealed. It is the intent
of the General Assembly that teachers, librarians, and administrators who are employed
in educational programs within correctional institutions under Title 22, Subtitle 1 of the
Education Article are to have their employment status changed from a 10-month per year
basis to a 12-month per year basis at the time the institutional educator pay plan
authorized by this Act takes effect.

SECTION 3. AND BE IT FURTHER ENACTED, That the Secretary of
Personnel, in consultation with the Department of Education and the appointing
authority of each of the employees affected by this Act, shall classify each current
employee affected by this Act in an appropriate classification, pay grade, and step under
the new institutional educator pay plan based on the employee's duties, responsibilities,
experience, education, and any other factor deemed relevant by the Secretary.

SECTION 4. AND BE IT FURTHER ENACTED, That, the term of each
member of the Institutional Educator Pay Plan Committee shall begin on April 15, 1994.

SECTION 5. AND BE IT FURTHER ENACTED, That, when the new
institutional educator pay plan is established as required by this Act, the Secretary of
Personnel shall adjust the salaries of affected employees according to the pay grade and
step assigned in the new pay plan. However, if the pay grade and step of any employee as
of June 1, 1994, exceeds the new pay grade and step for the employee's classification
under the new institutional educator pay plan, the employee's salary may not be
decreased, but shall remain at that level until the amounts set by the Secretary of
Personnel for that classification are increased to include that salary amount.

SECTION 6. AND BE IT FURTHER ENACTED, That the total amount of
salaries paid to institutional educators in fiscal year 1995 under the pay plan to be
established under this Act shall not exceed by more than 3% the total salaries that would
otherwise be paid to institutional educators in fiscal year 1995, if the fiscal year 1995
salaries were based on salary levels in effect on June 1, 1994, without regard to the
reduction in salaries resulting from the reduced work schedule in effect for fiscal year
1994 for correctional educational personnel. Notwithstanding any other provision of this
Act, the Secretary of Personnel shall make a pro rata reduction to the salaries of all
affected employees in order except those whose salaries are not adjusted in accordance
with Section 5 of this Act, to ensure that the total salaries paid to institutional educators
in fiscal year 1995 shall not exceed the 3% threshold specified in this section.

SECTION 7. AND BE IT FURTHER ENACTED, That the term of each
member of the Institutional Educator Pay Plan Committee shall begin on April 15, 1993.

SECTION 8. AND BE IT FURTHER ENACTED, That, when the new
institutional educator pay plan is established as required by this Act, the Secretary of
Personnel shall adjust the salaries of affected employees according to the pay grade and
