(Senate Bill 650)

AN ACT concerning

Anne Arundel County - Alcoholic Beverages
(Board Summons)

FOR the purpose of authorizing requiring the Anne Arundel County Board of License
Commissioners to charge a fee costs and fees for production and service of a
summons; specifying the fee fees and costs, and against whom it they may be
assessed; authorizing the service of summonses in Anne Arundel County by certain
persons; clarifying language and structure; and generally relating to alcoholic
beverages in Anne Arundel County.

BY repealing and reenacting, with amendments,
Article 2B - Alcoholic Beverages
Section 193

Annotated Code of Maryland
(1990 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland, read as follows:

Article 2B - Alcoholic Beverages

193.                                                                                                                           

(A)     (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2) "BOARD" MEANS THE COMPTROLLER, THE BOARDS OF LICENSE
COMMISSIONERS, OR THE MEMBERS OF THE BOARDS, AS APPROPRIATE.

(C)     "COUNTY" MEANS ANY COUNTY AND BALTIMORE CITY.

(D)     "SHERIFF" MEANS THE SHERIFF OF ANY COUNTY OR THE BALTIMORE
CITY POLICE DEPARTMENT.

(B)     (1) For the purpose of all hearings and inquiries which [the Comptroller
or] the board [of license commissioners for any county] is authorized to hold and make,
the [official, boards, and the respective members thereof, are authorized to] BOARD
MAY issue summonses for witnesses, and [to] administer to them oaths or affirmations [,
and all summonses so issued].               

(2) ALL SUMMONSES shall be served by [the police department of the City
of Baltimore or by] the sheriff [of any of the counties], EXCEPT THAT IN ANNE
ARUNDEL COUNTY, SUMMONSES MAY ALSO BE SERVED BY INSPECTORS EMPLOYED
BY THE BOARD AND BY THE ANNE ARUNDEL COUNTY POLICE DEPARTMENT. If any
witness [so summoned shall refuse or neglect] SUMMONED REFUSES OR NEGLECTS to
