8-1804.

(a) The Commission consists of 27 voting members who are appointed by the
Governor, as follows:

(4) The Secretaries of Agriculture, Economic and Employment
Development, Housing and Community Development, the Environment, Transportation,
and Natural Resources, and the Director of Planning, ex officio, or[,] the designee of the
Secretaries or the Director.

8-1808.3.

(f) A local jurisdiction may grant a variance from the provisions of this section in
accordance with regulations adopted by the Commission concerning variances as part of
local program development set forth in [COMAR 14.15.11] COMAR 27.01.11 and
notification of project applications set forth in [COMAR 14.20.01] COMAR 27.03.01.

Occurred: As a result of the August 1, 1992 recodification of portions of the
Code of Maryland Regulations relating to the Critical Area Commission.

8-1808.4.

(e) (3) A local jurisdiction may issue a building permit for a project involving
the construction of a dwelling unit or other non-water dependent structure on a pier
located on State or private wetlands within the Critical Area if:

(iv) The project is located in an intensely developed area, as
designated in programs adopted or approved by the Critical [Areas] AREA Commission
under this subtitle.
