BY repealing and reenacting, with amendments,
Article - State Personnel and Pensions
Section 3-402 and 3-405
Annotated Code of Maryland

(As enacted by Chapter____ (S.B. 50) of the Acts of the General Assembly of

1993)

Preamble

WHEREAS, Discrimination is prohibited by Title VII of the Civil Rights Act of
1964 as amended, and Article 49B of the Annotated Code of Maryland; and

WHEREAS, It is the clear and unequivocal policy of the State of Maryland to
assure equal employment opportunity to all its applicants and employees; and

WHEREAS, Applicants for and employees within unclassified contractual,
emergency, and temporary service are under the authority of the Secretary of the
Department of Personnel; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Personnel and Pensions

3-402.

This subtitle applies only to:

(1)      [classified service] ALL employees in the STATE PERSONNEL
MANAGEMENT SYSTEM WHO ARE EMPLOYED IN ANY UNIT OF THE executive branch
of State government; and

(2)     applicants for employment in the classified service of the Executive
Branch of State government.

3-405.

(a) Except as provided in subsection [(b)] (C) of this section, all personnel
actions CONCERNING ANY CLASSIFIED SERVICE EMPLOYEE OR APPLICANT FOR
EMPLOYMENT IN THE CLASSIFIED SERVICE shall be made without regard to:

(1)     age;

(2)     ancestry;

(3)     color;

(4)     creed;

(5)     marital status;
