AN ACT concerning

Out-of-State Medical Laboratories - Performing Tests and Examinations

FOR the purpose of authorizing certain persons to obtain a permit from the Secretary of
Health and Mental Hygiene to perform tests or examinations pertaining to
individuals in this State at a medical laboratory located outside this State under
certain circumstances; specifying the permit application procedures; and generally
relating to obtaining a permit to perform tests or examinations pertaining to
individuals in this State at a medical laboratory located outside this State.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

17-201.

(c) "Permit" means a permit issued by the Secretary:

(1)     To operate a medical laboratory in this State; [or]

(2)     To represent or service in this State a medical laboratory that is outside
this State; OR

(3)      TO PERFORM TESTS OR EXAMINATIONS PERTAINING TO
INDIVIDUALS IN THIS STATE AT A MEDICAL LABORATORY LOCATED OUTSIDE THIS
STATE.

(a) Except as otherwise provided in this subtitle, a person shall hold a permit
issued by the Secretary before the person may:

(1) Operate a medical laboratory in this State; [or]
