BY repealing and reenacting, with amendments,

Article 41 - Governor - Executive and Administrative Departments

Section 4-501(12)(ii)

Annotated Code of Maryland

(1990 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the subheading designation "Abortion" in Article 27 - Crimes and
Punishments of the Annotated Code of Maryland be repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 4 and 5,
respectively, of Article 27 - Crimes and Punishments - of the Annotated Code of
Maryland be renumbered to be Section(s) 3 and 4, respectively.

SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article 27 - Crimes and Punishments

Arson and Burning

COMMITTEE NOTE: The Committee to Revise Article 27 - Crimes and
Punishments of the Annotated Code of Maryland has included Committee
Notes as a guide to the Committee's reasoning in revising this subheading.
These notes have not been adopted by the General Assembly, and may not be
considered as part of the law.

5.

(A)     IN THIS SUBHEADING THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)     "DWELLING" MEANS A STRUCTURE, REGARDLESS OF WHETHER AN
INDIVIDUAL IS ACTUALLY PRESENT, ANY PORTION OF WHICH HAS BEEN ADAPTED
FOR OVERNIGHT ACCOMMODATION OF INDIVIDUALS, INCLUDING ANY KITCHEN,
SHOP, BARN, STABLE, OR OUTHOUSE THAT IS PARCEL TO, BELONGING TO, OR
ADJOINING THE STRUCTURE.

(C)     "MALICIOUSLY" DESCRIBES AN ACT DONE WITH INTENT TO HARM A
PERSON OR PROPERTY.
