Ch. 224                                     1993 LAWS OF MARYLAND

FINE OR PENALTY DEPOSIT ESTABLISHED BY THE CHIEF JUDGE OF THE DISTRICT
COURT BY ADMINISTRATIVE REGULATION, THE DISTRICT COURT SHALL IMPOSE ON
A DEFENDANT CONVICTED OF A CRIME AN ADDITIONAL COST OF $5 IN THE CASE.

(D) IN ADDITION TO ANY OTHER COSTS REQUIRED BY LAW, IF A CHILD IS
ADJUDICATED DELINQUENT UNDER TITLE 3, SUBTITLE 8 OF THE COURTS ARTICLE,
A JUVENILE COURT SHALL IMPOSE ON THE CHILD, THE CHILD'S PARENT, OR BOTH
AN ADDITIONAL COST OF $30 IN THE CASE.

[(d)](E) (1) All money collected under this section shall be paid to the
Comptroller of the State.

(3) The Comptroller shall deposit [$20 from each fee collected under this
section from a circuit court and $10 from each fee collected und
er this section from the
District Court] ONE HALF OF THE FEES THAT ARE COLLECTED UNDER THIS SECTION
into the Maryland Victims of Crime Fund establish
ed under Article 27, § 764(j) of the
Code.

(3) The Comptroller shall deposit all other moneys collected under this
section into the [G
eneral Fund of the State] CRIMINAL INJURIES COMPENSATION
FUND ESTABLISHED UNDER § 17A OF THIS ARTICLE.

(2) THE COMPTROLLER SHALL DEPOSIT THE FEES THAT ARE
COLLECTED UNDER THIS SECTION FROM PERSONS WHO ARE CONVICTED OF OR
ADJUDICATED DELINQUENT FOR CRIMES UNDER ARTICLE 27 OF THE CODE OR AT
COMMON LAW INTO THE GENERAL FUND OF THE STATE.

(3) SUBJECT TO PARAGRAPH (4) OF THIS SUBSECTION, THE
COMPTROLLER SHALL DEPOSIT ONE HALF OF THE FEES THAT ARE COLLECTED
UNDER THIS SECTION FROM PERSONS WHO ARE CONVICTED OF OR ADJUDICATED
DELINQUENT FOR VIOLATIONS OF THE TRANSPORTATION ARTICLE INTO THE
MARYLAND VICTIMS OF CRIME FUND ESTABLISHED UNDER ARTICLE 27, § 76
4(J) OF
THE CODE AND THE OTHER HALF OF THESE FEES INTO THE CRIMINAL INJURIES
COMPENSATION FUND ESTABLISHED UNDER § 17A OF THIS ARTICLE.

(4) THE TOTAL AMOUNT OF FEES DEPOSITED IN THE MARYLAND
VICTIMS OF CRIME FUND AND THE CRIMINAL INJURIES COMPENSATION FUND
UNDER PARAGRAPH (3) OF THIS SUBSECTION MAY NOT EXCEED $3,000,000. IF THE
AMOUNT OF FEES COLLECTED UNDER PARAGRAPH (3) IS MORE THAN $3,000,000 IN
ANY FISCAL YEAR, THE COMPTROLLER SHALL DEPOSIT THE EXCESS FEES IN THE
GENERAL FUND OF THE STATE.

(2)     The Comptroller shall deposit $20 from each fee collected under this section
from a circuit court and $10 from each fee collected under this section from the District Court
into the Maryland Victims of Crime Fund established under Article 27, § 764(j) of the Code.

(3)     The Comptroller shall deposit all other moneys collected under this section
into the [General Fund of the State] CRIMINAL INJURIES COMPENSATION FUND
ESTABLISHED UNDER § 17A OF THIS ARTICLE.
