1993 LAWS OF MARYLAND

(5)     28 grams or more of phencyclidine in liquid or powder form or 112 grams
or more of any mixture containing phencyclidine;

(6)     1,000 dosage units or more of methaqualone; [or]

(7)     28 grams or more of methamphetamines or any mixture containing 28
grams or more of methamphetamine; OR

(8)  4 GRAMS OR MORE OF FENTANYL OR A FENTANYL ANALOGUE OR
ANY MIXTURE CONTAINING FENTANYL OR A FENTANYL ANALOGUE.

(b) (1) [A person convicted of violating subsection (a) of this section is guilty of
a felony and may be fined not more than $50,000 or imprisoned for not more than 25
years, or both fined and imprisoned in the discretion of the court.] A PERSON WHO
VIOLATES OR CONSPIRES TO VIOLATE THIS SECTION IS GUILTY OF A FELONY AND
ON CONVICTION IS SUBJECT TO A FINE OF UP TO $50,000 OR IMPRISONMENT FOR NOT
LESS THAN 10 YEARS AND NOT MORE THAN 25 YEARS OR BOTH.

(2) (I) IT IS MANDATORY UPON THE COURT TO IMPOSE THE MINIMUM
SENTENCE OF 10 YEARS UNDER PARAGRAPH (1) OF THIS SUBSECTION.

(II) A COURT MAY NOT SUSPEND ANY PORTION OF THE
MANDATORY MINIMUM SENTENCE OF 10 YEARS.

(III) EXCEPT AS PROVIDED IN ARTICLE 31B, § 11 OF THE CODE, THE
PERSON IS NOT ELIGIBLE FOR PAROLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

(Senate Bill 140)

AN ACT concerning

Boating - Use of Public Safety Identification Light Signal

FOR' the purpose of altering the authority to use a certain identification light signal to
include use by an individual on certain vessels engaged in public safety activities;
establishing requirements for the use of the public safety identification light signal;
eliminating the requirement that an operator of a vessel shall yield right-of-way to
a vessel displaying the public safety identification light signal; establishing that use
of the public safety identification light signal does not convey any special privilege
to the vessel; defining a certain term; providing for the effective date of this Act;
and generally relating to the use of the public safety identification light signal.

BY repealing and reenacting, with amendments,
