Ch. 205                                     1993 LAWS OF MARYLAND

(6) "STALK" MEANS TO HARASS OR REPEATEDLY FOLLOW ANOTHER
PERSON IN SUCH A MANNER AS:

(I) TO CAUSE THAT PERSON TO SUFFER SUBSTANTIAL
EMOTIONAL DISTRESS; AND

(II) WOULD CAUSE A REASONABLE PERSON TO SUFFER
SUBSTANTIAL EMOTIONAL DISTRESS.

(B) A PERSON MAY NOT STALK ANOTHER PERSON WITH THE INTENT TO
PLACE THAT PERSON IN FEAR OF BODILY INJURY OR DEATH.

(C) IN A PROSECUTION UNDER THIS SECTION, THE INTENT REQUIREMENT
ESTABLISHED UNDER SUBSECTION (B) OF THIS SECTION SHALL BE SATISFIED IF IT IS
SHOWN THAT THE DEFENDANT KNEW OR SHOULD HAVE KNOWN THAT THE
DEFENDANT'S CONDUCT WOULD BE LIKELY TO CAUSE A PERSON TO FEAR BODILY

INJURY OR DEATH OR SUFFER SUBSTANTIAL EMOTIONAL DISTRESS.

(D) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY AND ON
CONVICTION IS SUBJECT TO A FINE OF UP TO $10,000 OR IMPRISONMENT FOR UP TO
10 YEARS OR BOTH.

(E) A SENTENCE IMPOSED UNDER THIS SECTION MAY BE IMPOSED SEPARATE
FROM AND CONSECUTIVE TO OR CONCURRENT WITH A SENTENCE FOR ANY OTHER
OFFENSE BASED UPON THE ACT OR ACTS ESTABLISHING A VIOLATION OF THIS
SECTION.

Article Courts and Judicial Proceedings

4-301.

(a) Except as provided in [§] §§ 4-302 and [§] 3-804 OF THIS ARTICLE, the
District Court has
exclusive original jurisdiction in a criminal case in which a person at
least 16 years old or a corporation is charged with violation of the vehicle laws, or the
Stat
e Boat Act, or rules and regulations adopted pursuant to it.

(b) Except as provided in § 4-302 OF THIS SUBTITLE, the District Court also has
exclusive original jurisdiction in a criminal case in which a person at least 18 y
ears old Of
a corporation is charged with:

(1) Commission of a common law or statutory misdemeanor regardless of
the amount of money or value of the property involved;

(2) Violation of §§ 342 through 344 of Article 27 of the Code, whether a
felony or a misd
emeanor;

(3) Violation of a county, municipal, or other ordinance, if the violation is
not a felony;

(4) Criminal violation of a State, county, or municipal rule or regulation, if
the
violation is not a felony;
