institutional educator pay plan, the Governor may transfer up to $1,355,000 based on revised
cost estimates from budget program 36.01.02.07 (Students with Disabilities) by approved
budget amendment to restore the employment status of teachers, librarians, and administrators
employed in educational programs in correctional institutions under Title 22, Subtitle 1 of the
Education Article from a 10-month to 12-month per year basis with a proportional increase in
pay as provided in the Fiscal Year 1994 Budget Bill and pay adjustments may be made only in
accordance with the authorized pay plan.
SECTION 12. AND BE IT FURTHER ENACTED, That, for fiscal year 1994,
notwithstanding any other provision of law and contingent on the taking effect of Chapter
______ (S.B. 771) of the Acts of the General Assembly of 1993 providing for a uniform pay
plan for teachers and other professional personnel at the campuses of the Maryland School for
the Deaf, pay adjustments may be made only in accordance with the pay play authorized under.
the provisions of Chapter (S.B. 771) of the Acts of the General Assembly of 1993.
SECTION 13. AND BE IT FURTHER ENACTED, That, for fiscal year 1995,
notwithstanding any other provision of law:
(a) A Board of Education, a Board of Community College Trustees, or a Board of
Library Trustees shall pay as provided in subsection (b) of this section a share of the
amount paid by the State on behalf of a member of the Teachers' Retirement System and
the Pension System for Teachers, the Public Library of Montgomery County, and the
optional retirement program if the member's compensation is paid by a Board of
Education, Board of Community College Trustees, or a Board of Library Trustees,
(b) (1) The share that shall be the obligation of and payable by each board in
the manner provided in paragraph. (2) of this subsection is the amount attributable to the
difference in a board's fiscal year 3994 payroll over the fiscal year 1991 payroll for
members, except for:
(i) Increases in the payroll resulting from net additional positions; and
(ii) Increases for performance, longevity, or individual salary increases
for members.
(2) (i) For the Teachers' Retirement System and the Pension System for
Teachers, the State Retirement Agency shall bill each board and each board shall pay for
the amount determined under paragraph (1) of this subsection.
(ii) For the Public Library of Montgomery County and the optional
retirement program, the State shall reduce State aid by the amount determined under
paragraph (1) of this subsection.
(c) In determining a board's fiscal year 1991 payroll for members, an adjustment
shall be made to annualize a general salary increase that took effect during the fiscal year
or to annualize teaching positions added during the fiscal year due to unanticipated
increases in enrollment.
(d) For the purpose of calculating any provision of State law requiring a local
board to pay a share of State contributions for retirement benefits or reducing State aid
for retirement benefits, the Board of Trustees of the Maryland State Retirement and
Pension Systems shall:
