branch of government, a position for which the salary by law is determined by judicial
salary, a position in an entity for which the budget of the entity is not required by law to
be included in the State budget bill, and a position in the legislative branch of
government; and
(3) The provisions of this subsection do not apply to any position for a judge
or for a person holding a public office whose term of office is 4 years or less. However, no
increase may be granted under the provisions of § 1-703(b) of the Courts and Judicial
Proceedings Article.
(c) Only in exceptional circumstances in order to retain an employee who is in a
position subject to the provisions of subsections (a) and (b) of this section may a salary
increase be provided in fiscal year 1994, with the proposed increase granted only if
approved as follows:
(1) For an employee in the judicial branch, if approved by the Chief Judge
of the Court of Appeals:
(2) For an employee in the legislative branch, if approved by the President
of the Senate and Speaker of the House of Delegates; and
(3) For any other employee subject to the provisions of this section, if
approved by the Board of Public Works.
SECTION 8. AND BE IT FURTHER ENACTED, That, the Department of Public
Safety and Correctional Services is requested to develop a program for the prevention and
deterrence of vehicle theft and to present a report with respect to the structure, implementation,
and funding of the program to the Legislative Policy Committee, Senate Budget and Taxation
Committee, Senate Judicial Proceedings Committee, House Appropriations Committee, and
House Judiciary Committee not later than January 1, 1994. If approved by the appropriate
legislative committees, the program could be implemented with a deficiency appropriation
submitted at the 1994 Session of the General Assembly.
SECTION 9. AND BE IT FURTHER ENACTED, That, for fiscal year 1994,
notwithstanding any other provision of law:
(a) No position graded above a grade 12, including those specified in subsection
(b) of this section, may be reclassified to a higher grade or level.
(b) Positions subject to the provisions of subsection (a) of this section include, but
are not limited to, positions that have a base starting salary equal to or exceeding $24,084
in any unit of State government that has independent pay setting authority, the
physician administrator pay schedule, an institution of higher education as defined in §
10-201 of the Education Article, the judicial branch of government or where the salary is
determined by judicial salary, an entity for which the budget of the entity is not required
by law to be included in the State budget bill, the legislative branch, or where the salary
of the position is determined in reference to local salaries by statute.
SECTION 9. AND BE IT FURTHER ENACTED, That, notwithstanding any other
provision of law, after making the distributions required under §§ 2 613 through 2 618 of the
Tax - General Article and before any distributions to the General Fund of the State under §
2-619 of the Tax - General Article, the Comptroller shall distribute to the Transportation Trust
