(6) (i) With the exception of the assistant sheriffs, all commissioned
full-time employees, including deputy sheriffs of all ranks, that are provided for by the
Sheriff in the budget of the county, shall be subject to the county personnel law.
(ii) The assistant sheriffs shall receive an annual salary of [$50,600]
$72,600 $52,624.
(7) All nonprobationary commissioned full-time employees, including
deputy sheriffs of all ranks, are subject to the Law Enforcement Officers' Bill of Rights.
They are also subject to the labor code of the county with regard to collective bargaining
for compensation, including pension and other fringe benefits. The County Executive
shall be considered the "employer" of the deputy sheriffs for the purpose of collective
bargaining only.
(8) The Sheriff and [his] THE SHERIFF'S deputies shall be limited in their
duties as law enforcement officers, as follows;
(i) The full power of arrest, the service Of process of all writs,
summonses, orders, petitions, subpoenas, warrants, rules to show cause, and all other
legal papers;
(ii) The care and supervision of prisoners at any of the county
detention centers, hospitals, penal institutions, or other places of confinement;
(iii) The security of all State and county courts and perform such duties
as may be required of them by the courts;
(iv) The transportation of all legally detained persons; and
(v) Neither the Sheriff of Prince George's County nor any of [his]
THE SHERIFF'S deputies shall conduct criminal investigations, except in matters
concerning the Sheriff's, department or upon request of the courts.
SECTION 2. AND BE IT FURTHER ENACTED, That, pursuant to Article III,
Section 35 of the Constitution of Maryland, this Act may not be construed to extend or
apply to the salary or compensation of the Sheriff of Prince George's County in office on
the effective date of this Act, but the provisions of this Act concerning the salary or
compensation of the Sheriff of Prince George's County shall take effect at the beginning
of the next following term of office.
SECTION 3. 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1993.
