authorizing issuance of a permit or authorizing construction until certain
stormwater runoff problems identified by the City ar
e resolved; and generally
relating to county stormwater management decisions affecting the City of Bowie in
Prince George's County

BY repealing and reenacting, with amendments,

Article 29 - Washington Suburban Sanitary District

Section 3-207

Annotated Code of Maryland

(1990 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 29 - Washington Suburban Sanitary District

3-207.

(a) (1) Prince George's County, Montgomery County, the City of Bowie, the
City of Takoma Park, and any person or any municipality may not adopt a stormwater
management plan, system, or design, including a capital improvement program for
stormwater management:

(i) Unless the stormwater management plan or design is in
accordance with the 6-year capital improvement program of the jurisdiction responsible
for stormwater management in the affected area and is approved by that jurisdiction; and

(ii) Except for the protection of an individual's home where it has no
adverse impact on other properties or stormwater management systems.

(2) (i) If Prince George's County, the City of Bowie, the City of Takoma
Park, or Montgomery County prepares a stormwater management plan, system, or design,
or if a stormwater management plan, system, or design has been submitted to the City of
Bowie, the City of Takoma Park, Montgomery County, or Prince George's County, the
City or the county shall submit a copy of the plan, system, or design to the WSSC. After
the submission, the WSSC shall have a specified, reasonable time to review and comment
on the plan, system, or design to the City or the county to indicate any conflicts in the
plan, system, or design with the existing or planned water supply or sanitary sewer systems
of the WSSC. The approval by Prince George's County, Montgomery County, the City of
Bowie, or the City of Takoma Park shall avoid any of the conflicts identified by the
WSSC.

(ii) When the WSSC receives a copy of a plan from the City of Bowie,
the WSSC shall promptly provide a copy to the County Council and County Executive of
Prince George's County for review and comment.

(iii) When the WSSC receives a copy of a plan from the City of Takoma
Park, the WSSC shall promptly provide a copy to the County Council and County
Executive of Montgomery County and the County Council and County Executive of
Prince George's County for review and comment.
