SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Finance and Procurement
3-401,
(a) This subtitle does not apply to changes relating to or the purchase, lease, or
rental of mechanical or electronic information processing equipment or associated
services by the University College of the University of Maryland for use in University
College overseas programs or by the Maryland Port Administration INFORMATION
TECHNOLOGY BY:
(1) THE UNIVERSITY COLLEGE OF THE UNIVERSITY OF MARYLAND SYSTEM
FOR USE IN UNIVERSITY COLLEGE OVERSEAS PROGRAMS;
(2) PUBLIC INSTITUTIONS OF HIGHER EDUCATION SOLELY FOR ACADEMIC
RESEARCH; OR
(3) THE MARYLAND PORT ADMINISTRATION.
[(b) (1) This subtitle does not apply to mechanical or electronic information
processing equipment or associated services to be used solely for academic or research
purposes by' public institutions of higher education or their governing boards. This
subtitle does apply to mechanical or electronic information processing equipment or
associated services to be used in whole or part for administrative use by public institutions
of higher education or their governing boards.
(2) Public institutions of higher education and their governing boards may
purchase, lease, or rent mechanical or electronic information processing equipment or
associated services to be used solely for academic or research purposes without the
approval of the Secretary.]
(B) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, EXCEPT AS
PROVIDED IN SUBSECTION (A) OF THIS SECTION, THIS SUBTITLE APPLIES TO ALL
UNITS OF THE EXECUTIVE BRANCH OF STATE GOVERNMENT INCLUDING THE
UNIVERSITY OF MARYLAND SYSTEM AND ALL OTHER INSTITUTIONS OF HIGHER
EDUCATION.

(a) The Secretary is responsible for planning and controlling information
processing in units of the Executive Branch of the State government.
(b) The Secretary shall review and has approval authority, over information
processing master plans of units of the Executive Branch of the State government.
