(3) THE DEPARTMENT MAY COMPROMISE OR SETTLE AND RELEASE ITS
SUBROGATION CLAIM IF, IN ITS JUDGMENT, COLLECTION OF THE CLAIM WILL
CAUSE SUBSTANTIAL HARDSHIP TO THE PROGRAM RECIPIENT OR IN A WRONGFUL
DEATH ACTION, THE SURVIVING DEPENDENT OF A DECEASED PROGRAM
RECIPIENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1 October 1, 1993.

AN ACT concerning

Maryland Pharmacy Assistance Program

FOR the purpose of repealing the termination provision extending the termination date
for certain limitations of coverage and copayment requirements in the Maryland
Pharmacy Assistance Program.

BY repealing and reenacting, without amendments,
Article - Health - General
Section 15-124
Annotated Code of Maryland
(1990 Replacement Volume and 1992 Supplement)

BY repealing and reenacting, with amendments,

Chapter 401 of the Acts of the General Assembly of 1991
Section 3

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

15-124.

(a) (1) The Department shall maintain a Maryland Pharmacy Assistance
Program for low income individuals whose:

(i) Assets are not more than 1.5 times the amount of accountable
resources according to the asset schedule of the Maryland Medical Assistance Program;
and

(ii) Gross annual income does not exceed:
