Ch. 59                                       1993 LAWS OF MARYLAND

(i) State that there is an application for a landfill system or incinerator for
public use to burn solid waste pending before the Department; and

(2) Give the date, time, and place that the Department sets for the hearing.

(f) At the hearing, the applicant and any other interested person may offer
evidence and present arguments for or against the application.

(g)] (D) To the extent practicable, the Department and other units of the State
government shall consolidate hearings concerning permits for the same landfill system of
incinerator for public use.

9-324. ISSUANCE OF DISCHARGE PERMIT.                                                             

(a)     Subject to the provisions of this section, the Department may issue a discharge
permit if the Department finds that the discharge meets:

(1)     All applicable State and federal water quality standards and effluent
limitations; and

(2)     All other requirements of this subtitle.

(b)     Before issuing a discharge permit, the Department shall[:

(1)     In appropriate cases, hold an information meeting; and

(2)     Provide an opportunity for a hearing on the subject] COMPLY WITH
THE PROVISIONS OF TITLE 1, SUBTITLE 6 OF THIS ARTICLE.                               

(c)     The information meeting REQUIRED BY TITLE 1, SUBTITLE 6 OF THIS
ARTICLE shall be held [at least 15 days before the public hearing] in the geographical
area that will be MOST DIRECTLY affected if the discharge permit is issued.

(d)     The Department shall give public notice of each application for a discharge
permit AS REQUIRED BY TITLE 1, SUBTITLE 6 OF THIS ARTICLE, AND by[:       

(1)     Providing appropriate notice of the application for a discharge permit
within 30 days after receipt of the application;

(2)     At least 30 days before the public hearing, inserting an appropriate
notice for at least 1 business day in a newspaper of general circulation in the county
where the facility for which the permit is sought is located;

(3)     Making] MAKING available to the public appropriate documents,
permit applications, supporting material, plans, and other relevant information[; and

(4)     Sending copies of the notice of public hearing to the units of local
government, including local sewer and water agencies, that have jurisdiction over the area
where the facility for which the permit is sought is located].
