(d) An applicant is not required to pass a test to obtain a new tidal fish license
under this section.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

measure, is necessary for the immediate preservation of the public health and safety, has
been passed by a yea and nay vote supported by three-fifths of all the members elected to
each of the two Houses of the General Assembly, and shall take effect from the date it is
enacted.

AN ACT concerning
Insurance - Hearings
FOR the purpose of providing for the delegation of the hearing authority of the
Insurance Commissioner to a designee certain designees of the Commissioner for
hearing certain cases, including cases relating to cease and desist orders; and
generally relating to the delegation of the hearing authority of the Commissioner.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 48A - Insurance Code
35.
(1) (I) (A) (1) The Commissioner OR A DESIGNEE OF THE COMMISSIONER
may hold hearings for any purpose within the scope of this article deemed by him to be
necessary.
(II) THE COMMISSIONER MAY DELEGATE THE RESPONSIBILITIES FOR
HOLDING HEARINGS UNDER THIS SECTION TO THE DEPUTY COMMISSIONER, AN
ASSOCIATE DEPUTY COMMISSIONER, OR AN ASSOCIATE COMMISSIONER.
