Commission may exempt a public official or employee from the
prohibition of paragraph (1) of this subsection if the
Commission, based upon the recommendation of the Governor upon
request of the executive agency involved, concludes that:

(i) Failure to grant the exemption would reduce
the ability of the State to:

Occurred: The errors in subsection (a)(l)(i) and
(3)(i)2 occurred in Ch. 796, Acts of 1981. The error
in subsection (a)(2)(iii) occurred as a result of a
printing error in Ch. 322, Acts of 1988.

Article 41 - Governor - Executive and Administrative Departments

1-201.

[(a)] Each principal department shall be headed by a
secretary appointed by the Governor with the advice and consent
of the Senate and serving at the Governor's pleasure, unless
otherwise provided by law. Each secretary shall be selected on
the basis of his professional and administrative knowledge and
experience and have additional qualifications as further provided
in law. He shall receive the salary and have the assistants,
employees, and professional consultants provided in the budget,
unless otherwise provided by law, within his assigned
jurisdiction. He is responsible for establishing policy to be
followed by the departments, offices and other units of the State
government within the principal department. He is responsible for
the efficient and orderly administration of the department. He is
responsible for the comprehensive planning of programs and
services within his jurisdiction and for reviewing and approving
the plans of all departments and other units of the State
government within his jurisdiction. He is responsible for the
budget of his office and for the budgets of other units of the
State government within his jurisdiction. He is responsible for
the organization of his office and for recommending to the
Governor changes in the organization and placement of units of
the State government within his jurisdiction. He may appoint
officers and employees in his office as provided in the budget
and review the personnel action taken by any unit of the State
government within his jurisdiction. He may create the citizen
advisory bodies he deems necessary for the operation of his
department and shall recommend to the Governor any modification,
