3-209. ESTABLISHMENT OF FEES; DISPOSITION OF MONEY.

(A)  ESTABLISHMENT OF FEES.

SUBJECT TO THE MAXIMUM AMOUNTS AND OTHER LIMITATIONS
SPECIFICALLY SET BY THIS TITLE, THE BOARD SHALL SET REASONABLE
FEES FOR THE ISSUANCE AND RENEWAL OF LICENSES AND PERMITS AND ITS
OTHER SERVICES.

(B)  DISPOSITION OF MONEY.

EXCEPT AS OTHERWISE PROVIDED BY LAW, THE BOARD SHALL PAY ALL
MONEY COLLECTED UNDER THIS TITLE INTO THE GENERAL FUND OF THE
STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second clause of
former Art. 56, § 466(h) and the first sentence and
the introductory language of the second sentence of §
472(a).

In subsection (a) of this section, the reference to
"other limitations" is added as a general reference to
specific requirements set out elsewhere in this title.
See, e.g., § 3-304(2) of this title, which requires an
application fee to approximate the cost of giving an
examination to an applicant.

Also in subsection (a) of this section, the former
word "schedule" is deleted to avoid the seemingly
unintended suggestion that a fee need not be
reasonable if, as a whole, the schedule of fees is.

Also in subsection (a) of this section, the former
word "charges" is deleted as unnecessary in light of
the word "fees".

Also in subsection (a) of this section, the former
phrase "from time to time" is deleted as surplusage.

The introductory language of subsection (b) of this
section, "[e]xcept as otherwise provided by law", is
added in light of the provisions for the Licensing
Testing Fund under Art. 41, § 8-104(g) of the Code.
