5-313. PREPARATION OF COMPLAINTS IN MONTGOMERY COUNTY.

IN MONTGOMERY COUNTY, THE FOLLOWING INDIVIDUALS ARE NOT
LIABLE TO ANY PERSON FOR ADVICE OR HELP GIVEN IN THE COURSE OF
EMPLOYMENT IN CONNECTION WITH THE PREPARATION OF A COMPLAINT:

(1)  A CLERK OF ANY COURT OR AN EMPLOYEE OF A CLERK;

(2)  THE SHERIFF OR A DEPUTY SHERIFF; OR

(3)  AN EMPLOYEE OF THE REGISTER OF WILLS.

REVISOR'S NOTE: Ch. ___, Acts of 1989, which enacted the

Business Occupations Article, also added this section
to incorporate the third sentence of former Art. 10, §
30.

The Business Occupations Article Review Committee
determined that the provision concerning the immunity
of certain individuals from liability would be more
appropriate in this subtitle, since it includes other
prohibited actions.

6-407. AUTOMATIC TERMINATION OF APPEARANCE OF ATTORNEY.

(A)  IN GENERAL.

EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, THE
APPEARANCE OF AN ATTORNEY AT LAW IN ANY CASE BEFORE A COURT IN
THE STATE TERMINATES AUTOMATICALLY ON THE EXPIRATION OF AN APPEAL
PERIOD DURING WHICH NO PARTY ENTERS AN APPEAL FROM A FINAL
JUDGMENT.

(B)  EXCEPTION.

ON THE MOTION OF THE COURT THAT HAS JURISDICTION OVER A CASE
OR ON THE MOTION OF A PARTY, THE COURT MAY SUSPEND THE
TERMINATION OF APPEARANCE UNDER SUBSECTION (A) OF THIS SECTION.

REVISOR'S NOTE: Ch. ___, Acts of 1989, which enacted the

Business Occupations Article, also repealed former CJ
§ 6-407 and enacted this section to incorporate the
provisions of former Art. 10, § 45. Except for the
fact that former Art. 10, § 45 applied to any case in
a court of original jurisdiction and former CJ § 6-407
applied only to civil cases in District Court, the
former sections were duplicative.
