WILLIAM DONALD SCHAEFER, Governor
Ch. 3
REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
the first sentence of former Art. 56, § 336(e), as
that clause related to the certificate of
authorization required for corporations and
partnerships, and revised to state affirmatively that
a corporation or partnership must hold a permit to
operate a business that provides land surveying or
property line surveying services.
The defined term "permit" is substituted for the
former reference to the "certificate of authorization"
of a corporation or partnership, to provide a term
that describes the authority granted a corporation or
partnership and is consistent with the language used
to describe similar grants of authority in connection
with other business occupations that are regulated
under this article. See the General Revisor's Note to
this article.
Defined terms: "Board" § 15-101
"Permit" § 15-101
"Practice land surveying" § 15-101
"Practice property line surveying" § 15-101
15-403. APPLICATIONS FOR PERMITS.
AN APPLICANT FOR A PERMIT SHALL:
(1) SUBMIT TO THE BOARD AN APPLICATION ON THE FORM
THAT THE BOARD PROVIDES; AND
(2) PAY TO THE BOARD AN APPLICATION FEE OF $50.
REVISOR'S NOTE: Item (1) of this section is standard
language added to state expressly that which only was
implied in the former law -- i.e., permit applications
must be made but only on the form that the Board
provides.
Item (2) of this section is new language derived
without substantive change from the first clause of
the first sentence of former Art. 56, § 336(e) and, as
it related to payment of fees to the Board, the first
sentence of § 334(a).
In item (2) of this section, the reference to an
"application" fee is substituted for the former
reference to a "registration fee" since the fee is, in
fact, paid on application for a permit. Therefore
former Art. 56, § 336(f), as that subsection provided
that, if the Board did not issue a permit to an
applicant, the fee would be retained "as an
application fee", is deleted as unnecessary.
