WILLIAM DONALD SCHAEFER, Governor

Ch. 3

In subsection (a)(4) of this section, the phrase "on
the form that the Board provides" is substituted for
the former requirement to make application "in
writing". This substitution is standard language used
to state expressly that which only was implied in the
former law -- i.e., applications for a limited license
may be made only on the form that the Board provides.

Subsection (c)(1) of this section clarifies the former
law by stating expressly that the Board states the
term of a limited license in the limited license.

Subsection (c)(3) of this section states expressly
that which only was implied in the former law -- i.e.,
a limited license expires on the dates set by the
Board.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
this section is revised to resolve the' conflicting
provisions of former Art. 56, § 339 as to the purpose
and term of the special license that former § 339
authorized. On analysis, the Committee concluded that
former § 339 actually provided for the issuance of a
license for 2 different purposes. The first purpose
was a license that could be issued to a professional
land surveyor from another state, to work on a
specific project, for a term not to exceed 1 year.
This section sets forth a revision of the provisions
for the license that may be issued for that purpose
and refers to a "limited" license, since licenses
issued under this section are restricted in scope as
well as duration.

The second purpose was a license that authorized
general practice by a professional land surveyor from
another state, but only for a temporary period while
the professional land surveyor applies for a license
from this State, and the Board acts on the
application. Section 15-317 of this subtitle revises
the provisions for the "temporary" license that may be
issued for that purpose.

Defined terms: "Board" § 15-101
"Practice land surveying" § 15-101
"State" § 1-101

15-317. TEMPORARY LICENSE.

(A) IN GENERAL.

THE BOARD MAY ISSUE A TEMPORARY LICENSE TO PRACTICE LAND
SURVEYING TO ANY APPLICANT WHO:
