(D) CONFERENCE WITH BOARD MEMBER.

(1)  SUBJECT TO THIS SUBSECTION, AN APPLICANT WHO
FAILS AN EXAMINATION 3 TIMES MAY HAVE A CONFERENCE WITH A MEMBER
OF THE BOARD.

(2)  TO HAVE A CONFERENCE UNDER THIS SUBSECTION, AN
APPLICANT SHALL SUBMIT A WRITTEN REQUEST TO THE BOARD WITHIN 45
DAYS AFTER THE DATE ON WHICH THE BOARD MAILS NOTICE OF THE
APPLICANT'S 3RD FAILURE.

(3)  AN APPLICANT WHO DOES NOT REQUEST A CONFERENCE IN
ACCORDANCE WITH PARAGRAPH (2) OF THIS SUBSECTION WAIVES THE RIGHT
TO HAVE A CONFERENCE UNDER THIS SUBSECTION.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from the
references, in former Art. 56, § 337(d)(2) and (4), to
addresses to which a notice is to be mailed and
revised to state affirmatively the Board must notify
applicants who fail examinations.

Subsections (b) through (d) of this section are new
language derived without substantive change from
former Art. 56, § 337(d)(2) and (4), except for the
references to addresses to which notices are to be
mailed, and the first sentence of (3).

In subsections (c) and (d) of this section, the word
"written" is added for clarity and conformity to
subsection (b) of this section.

The second sentence of former Art. 56, § 337(d)(3),
which stated that no review of an examination, other
than a confirmation of a test score, would be
provided, is deleted as erroneous in light of
subsections (b) and (d) of this section.

15-309. SAME -- REEXAMINATION.

(A) IN GENERAL.

SUBJECT TO THIS SECTION, IF AN APPLICANT FAILS AN
EXAMINATION GIVEN UNDER THIS SUBTITLE, THE APPLICANT MAY RETAKE
THE EXAMINATION.

(B) PROCEDURE ON 1ST OR 2ND FAILURE.

EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS SECTION, AN
APPLICANT FOR REEXAMINATION SHALL:
