(2) THE BOARD MAY REINSTATE A LICENSE UNDER PARAGRAPH
(1)(II) OF THIS SUBSECTION ONLY IF THE INDIVIDUAL:
(I) MEETS THE RENEWAL REQUIREMENTS OF § 14-314
OF THIS SUBTITLE;
(II) IF REQUIRED BY THE BOARD, STATES REASONS
WHY REINSTATEMENT SHOULD BE GRANTED; AND
(III) PAYS TO THE BOARD A REINSTATEMENT FEE OF
$20.
REVISOR'S NOTE: Subsections (a)(1) and (3) and (b)(1) and
(2)(ii) and (iii) of this section are new language
derived without substantive change from the seventh
through ninth sentences of former Art. 75 1/2, § 13(b)
and, as it related to payment of fees to the Board,
the first sentence of § 9.
Subsections (a)(2) and (b)(2)(i) of this section are
standard language added to state expressly that which
only was implied in the former law -- i.e., an
engineer must comply with the renewal requirements of
this title before the Board may reinstate the expired
license of the engineer.
In subsections (a) and (b) of this section, the word
"reinstate" is substituted for the former word
"renew[ed]", to clarify distinctions between renewal
of a license under § 14-314 of this subtitle and
reinstatement of a license under this section.
In subsection (a)(3) of this section, the former
reference to a fee of "$30" to be paid on application
for renewal during the first 2 years after expiration
of the license is revised for clarity to provide for
the payment of a $10 reinstatement fee that is to be
paid in addition to the renewal fee, which, under §
14-314 of this subtitle, is $20.
In subsection (b)(2)(iii) of this section, the
specific amount of $20 is substituted for the former
general language that provided that the reinstatement
fee "shall be the same as the registration fee". The
"registration fee" under former Art. 75 1/2, § 13(a)
was $20. See § 14-312 of this subtitle.
The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
the $20 fee set forth under subsection (b)(2)(iii) of
this section does not seem to be in proportion to the
other fees set under this subtitle. The fee for a
