Ch. 3

This misconception was reinforced by the erroneous
reference to "the practice of engineering as a[n] ...
engineer-in-training" in the disciplinary ground set
forth under former Art. 75 1/2, § 17(a)(2). The
substituted language gives effect to the intended
purpose of the former provisions, without using the
term "engineer-in-training". The emphasis of the new
language is on the right to take the examination early
and the procedures that relate to that right. To the
casual reader, the extreme changes in organization and
language may appear to effect changes in substance.
The substituted language does not, however; it merely
achieves the same substantive purpose with more
simplicity and clarity.

Subsection (b)(1) of this section is based on the
third sentence of former Art. 75 1/2, § 14(a), as
enacted by Ch. 47, Acts of 1985. That former sentence
specified only the right to take the examination; it
did not set forth provisions for making application
for the examination or any provision on the effect of
passing or failing the examination. However, it was
the purpose of Ch. 47, Acts of 1985, to apply the same
procedures and to obtain the same consequences under
this provision as those procedures and consequences
that formerly pertained to an individual who applied
to be an engineer-in-training -- i.e., to an
individual who applied for early examination under
subsection (b)(2) of this section. The language of
this section, therefore, clearly provides that all of
the provisions that apply to an applicant for
examination under subsection (b)(2) of this section
also apply to an applicant under (b)(1) of this
section.

14-311. WAIVER OF EXAMINATION REQUIREMENTS.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD MAY
WAIVE ANY EXAMINATION REQUIREMENT OF THIS SUBTITLE FOR AN
INDIVIDUAL WHO IS LICENSED TO PRACTICE ENGINEERING IN ANOTHER
STATE.

(B)  CONDITIONS.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF THE
APPLICANT:

(1) IS OF GOOD CHARACTER AND REPUTATION;
