WILLIAM DONALD SCHAEFER, Governor
Ch. 3
Subsection (a)(5) of this section is revised to
resolve an ambiguity in former Art. 75 1/2, § 3(c), by
clearly providing that the 4 professional entities
submit a list of names only for the engineer member
whose specialty corresponds to that of the entity.
In subsection (a)(5)(iv) of this section, the word
"Electronics" is substituted for the former word
"Electronic" to correct the name of the Institute.
In subsection (g)(4) of this section, the clause
"until a successor is appointed and qualifies" is
added to avoid gaps in membership by indicating that a
member serves until a successor takes office. This
addition is supported by the cases of Benson v.
Mellor, 152 Md. 481 (1927), and Grooms v. LaVale
Zoning Board, 27 Md. App. 266 (1975).
In subsection (h) of this section, the former phrases
"with the advice of the Secretary of Licensing and
Regulation" are deleted as misleading. Although
former Art. 75 1/2, § 6 seemed to imply that removal
by the Governor of a Board member required the advice
of the Secretary, Md. Constitution, Art. II, § 15
makes it clear that the power of the Governor is not
so limited. For other provisions on removal, see: Md.
Constitution, Art. XV, § 2, on suspension and removal
for crimes, and Art. 41, § 1-203 of the Code, on
removal for failure to attend meetings.
Defined terms: "Board" § 14-101
"Consumer member" § 1-101
"Engineer" § 14-101 "License" § 14-101
"Person" § 1-101 "Practice engineering" § 14-101
"Responsible charge" § 14-101 "Secretary" § 1-101
14-203. OFFICERS.
(A) IN GENERAL.
FROM AMONG ITS MEMBERS, THE BOARD ANNUALLY SHALL ELECT A
CHAIRMAN, A VICE CHAIRMAN, AND A SECRETARY.
(B) ELECTIONS.
THE MANNER OF ELECTION OF OFFICERS SHALL BE AS THE BOARD
DETERMINES.
REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from the
fourth sentence of former Art. 75 1/2, § 7.
