"charterer" is substituted for the former, erroneous
term "consignee", to clarify the persons who are
liable for payments under this section.

under this section" are substituted for the former
words "incident to the provision of this section", for
clarity and brevity.

SUBTITLE 7. PROHIBITED ACTS; PENALTIES.

11-701. PROVIDING PILOTAGE WITHOUT LICENSE.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A PERSON MAY NOT
PROVIDE, ATTEMPT TO PROVIDE, OR OFFER TO PROVIDE PILOTAGE IN THE
STATE UNLESS LICENSED BY THE BOARD.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 74, § 6.

The references to "attempt" and "offer" to provide
pilotage are added to conform to similar provisions
governing other regulated occupations of the Code.

The former reference to "a branch ... to the destined
port of said vessels" is deleted as obsolete and
unnecessary in light of the words "licensed by the
Board".

As to the referenced exceptions, see § 11-401 of this
title.

11-702. MISREPRESENTATION.

UNLESS AUTHORIZED UNDER THIS TITLE TO PROVIDE PILOTAGE, A
PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF A TITLE,
INCLUDING "PILOT", "BAY PILOT", "LICENSED PILOT", "STATE LICENSED
PILOT", OR "MARYLAND PILOT", BY DESCRIPTION OF SERVICES, METHODS,
OR PROCEDURES, OR OTHERWISE, THAT THE PERSON IS AUTHORIZED BY THE
STATE TO PROVIDE PILOTAGE.

REVISOR'S NOTE: This section is standard language added to
correspond to similar sections of other titles of this
article. It is an inherent, if not essential,
corollary of § 11-701 of this subtitle.
