Subsection (b)(1) of this section is new language
added to reflect the requirements of § ll-406(c) of
this title, under which each license must be issued
under the seal of the Board.

The introductory phrases of subsections (a) and (b) of
this section, "[i]n addition to any [powers and
duties] set forth elsewhere", are added to clarify
that the enumerated powers and duties are not
exhaustive.

In subsection (a) of this section, the former express
restriction that the regulations not be contrary to
the provisions of former Art. 74 is deleted as
surplusage.

Also in subsection (a) of this section, the former
words "as they may think proper" are deleted as
unnecessary in light of the word "may". In any event,
the Secretary has general supervisory responsibility
over the exercise of powers, § 11-208 of this
subtitle, but particularly over rulemaking. See Art.
41, §§ 1-202 and 8-104(b) of the Code.

In subsection (b) of this section, the former
reference to responsibility "for the licensing and
disciplining of pilots" is deleted as unnecessary in
light of the detailed licensing and disciplinary
provisions of Subtitle 4 of this title.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
the language of subsection (a) of this section differs
from the language of comparable provisions in other
titles of this article, which provide authority to
adopt regulations and pass orders "to carry out" the
provisions of the particular title. However, since
concern was raised that the standard language would
narrow the regulatory power of the Board, the
provisions of subsection (a) of this section reflect
closely the language of the former law.

THE BOARD SHALL RECEIVE ALL FEES AND OTHER CHARGES
COLLECTIBLE UNDER §§ 11-406, 11-408, AND 11-705 OF THIS TITLE.
