establishing a Maryland Underground Storage Tank Fund (UST Fund) in the Department of the Environment; requiring a person transferring gasoline and diesel fuel into the State to pay a certain fee per barrel of gasoline transferred; requiring certain owners and operators of certain underground tanks to pay a certain tank fee on or before a certain date; providing for the deposit of certain fees into the UST Fund; establishing certain maximum and minimum balances in the Fund for making a certain determination on the collection of fees; providing for the relationship between the UST Fund and the existing Maryland Oil Disaster Containment, Clean-up and Contingency Fund; establishing certain purposes for the allocation of money in the UST Fund; requiring the owner or operator of certain underground tanks to take corrective action under certain circumstances; authorizing the Department to take certain corrective actions under certain circumstances; authorizing certain owners or operators to apply for reimbursement for certain costs or for a certain guarantee of payment from the UST Fund, subject to certain deductible amounts; establishing a certain limit on the amounts of money that may be distributed from the UST Fund; requiring owners and operators to demonstrate certain financial assurance; establishing certain eligibility requirements for a certain reimbursement or guarantee of payment from the UST Fund; providing for certain cost recovery by the Department under certain circumstances; providing for the reimbursement of third party claims under certain circumstances; providing for a certain priority of uses of the Fund; providing for certain notice and hearings for certain aggrieved parties; requiring the Department to adopt certain regulations; requiring the Department to prepare and submit a certain report on the UST Fund; providing a certain date for reimbursement from the UST Fund; altering certain definitions; authorizing the State Attorney General to intervene in certain civil actions; defining certain terms; clarifying language; and generally relating to water quality and oil discharge control and clean-up in the State.
