Ch. 3
LAWS OF MARYLAND
for the former limited reference to "§ 14A of Article
27" to reflect Rules 18 and 19 of the Rules Governing
Admission to the Bar, which, respectively, allow a law
student to practice law under the supervision of a
supervising attorney and allow a lawyer who is a
member of the bar of another state to practice law in
this State while employed in an approved legal
services program.
Also in subsection (a) of this section, the reference
to "attempt to practice" is added to conform to
similar provisions that govern other regulated
occupations in the Code. Similarly, the reference to
an "offer to practice" is made generally applicable,
rather than applicable only to corporations and
voluntary associations under former Art. 27, § 14A.
In subsection (b) of this section, the word "or" is
used to connect the items of this subsection to
indicate they are disjunctive, not conjunctive.
In subsection (c) of this section, the reference to a
"partner" is added for clarity.
As to the power of the Court of Appeals to prohibit an
individual from practicing law, even though admitted
to the Bar, unless the individual pays an annual fee
to the Clients' Security Trust Fund, see §
10-311(c)(2) of this title.
As to the referenced exceptions, see §§ 10-102 and
10-206 of this title.
Defined terms: "Bar" § 10-101
"Lawyer" § 10-101 "Person" § 1-101
"Practice law" § 10-101
10-602. MISREPRESENTATION AS AUTHORIZED PRACTITIONER.
UNLESS AUTHORIZED BY LAW TO PRACTICE LAW IN THE STATE, A
PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF A TITLE,
INCLUDING "LAWYER", "ATTORNEY AT LAW", OR "COUNSELOR AT LAW", BY
DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR OTHERWISE,
THAT THE PERSON IS AUTHORIZED TO PRACTICE LAW IN THE STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 10, §
33(a) and (b)(1) and the first sentence of former Art.
27, § 14 and rephrased in the standard language used
throughout this article to express a prohibition
against false representations of authority to practice
a State-regulated occupation.
