SUBTITLE 4. INVESTIGATION OF UNAUTHORIZED PRACTICE;
INJUNCTIVE ACTION.

10-401. INVESTIGATION BY ATTORNEY GENERAL -- AUTHORIZED.

THE ATTORNEY GENERAL MAY INVESTIGATE, AS PROVIDED IN THIS
SUBTITLE, A COMPLAINT OF AN UNAUTHORIZED PRACTICE OF LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause of
former Art. 10, § 26B(a).

Defined term: "Practice law" § 10-101

10-402. SAME -- CONFIDENTIAL.

(A)   IN GENERAL.

(1)  EACH INVESTIGATION CONDUCTED UNDER THIS SUBTITLE
IS CONFIDENTIAL.

(2)  EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, A
PERSON WHO PARTICIPATES IN AN INVESTIGATION MAY NOT DISCLOSE THE
NAME OF A PERSON UNDER INVESTIGATION, THE NAME OF A WITNESS, OR
ANY OTHER INFORMATION OBTAINED IN THE INVESTIGATION.

(B)  EXCEPTION.

A PERSON WHO PARTICIPATES IN AN INVESTIGATION MAY DISCLOSE
INFORMATION TO:

(1)  THE PERSON UNDER INVESTIGATION; AND

(2)  A PERSON TO WHOM DISCLOSURE IS REQUIRED IN THE
DISCHARGE OF AN OFFICIAL DUTY.

(C)  VIOLATION CONSTITUTES MISDEMEANOR.

A PERSON WHO VIOLATES SUBSECTION (A)(2) OF THIS SECTION IS
GUILTY OF A MISDEMEANOR.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 10, §
26B(e).

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
while subsection (c) of this section makes
unauthorized disclosures "a misdemeanor", no penalties
are provided.
