Preamble
WHEREAS, Joint Resolution No. 18 of the 1985 Session of the
General Assembly of Maryland requested the Maryland Environmental
Service, in conjunction with the predecessor to the Department of
the Environment, to study the feasibility of developing "amnesty"
programs to provide an opportunity for homeowners, farmers, and
commercial businesses to dispose of small quantities of hazardous
substances at no cost to the participant; and
WHEREAS, On January 1, 1986, the Maryland Environmental
Service reported its findings to the Governor and General
Assembly in a report entitled "Feasibility Study of Special
Collection of Household Hazardous Waste"; and
WHEREAS, The most common materials in the category of
household hazardous waste are motor oils, pesticides, paints, and
solvents; and
WHEREAS, Under current federal and State laws, any person
who generates 100 kilograms (220 pounds) or more per month of
controlled hazardous substances must comply with applicable rules
for generators, including the manifest system for transportation
of controlled hazardous substances; and
WHEREAS, Household hazardous waste currently is not
controlled under federal or State laws if the amount of the
hazardous waste generated is less than 100 kilograms (220 pounds)
per month; and
WHEREAS, A homeowner may keep, store, or legally dispose of
household hazardous waste through normal solid waste collections,
as well as dispose of such waste into sewers or septic tanks or
by backyard dumping; and
WHEREAS, There is a desire to provide a mechanism for the
proper handling of household hazardous waste in an orderly manner
to address a serious safety and environmental problem; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
