WILLIAM DONALD SCHAEFER, Governor Ch. 815

(i) The director and deputy director shall be
appointed by the Secretary of Natural Resources, with the
approval of the Governor, solely with regard to the
qualifications for the duties of the office. The director and
deputy director serve at the pleasure of the Secretary of Natural
Resources and shall receive the compensation provided in the
State budget; and

(ii) The secretary and treasurer shall be
appointed by the Secretary of Natural Resources, with the
approval of the Governor and the advice and consent of the Senate
solely with regard to the qualifications for the duties of the
office. The secretary and treasurer serve at the pleasure of the
Secretary of Natural Resources and shall receive the compensation
provided in the State budget.

(2)  The board of directors of the Service shall
consist of 7 members as follows:

(i) The director, deputy director, secretary,
and treasurer of the Service;

(ii) 1 member from the public sector in the
State in a position responsible for water, wastewater, or solid
waste management; and

(iii) 2 members from the private sector in the
State with technical, financial, development, or legal experience
related to water, wastewater, or solid waste management.

(3)  The public sector and private sector members of
the board, as set forth in paragraph (2)(ii) and (iii) of this
subsection shall be appointed by the Secretary of Natural
Resources, with the approval of the Governor and the advice and
consent of the Senate.

(4)  Five members constitute a quorum for the
transaction of business of the board. The affirmative vote of at
least 4 members is necessary for any action taken by the board.

(5)  Those members of the board not already holding a
public office shall receive:

(i) Per diem compensation in accordance with
the State budget; and

(ii) Reimbursement for expenses under Standard
State Travel Regulations.

(6)  The term of a member who is not an officer of the
Service is 4 years.
