(9) 1 REPRESENTATIVE OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE DESIGNATED BY THE SECRETARY OF HEALTH AND MENTAL
HYGIENE WHO SHALL BE A NONVOTING MEMBER; AND

[(7)] (10) 12 members appointed by the Governor:

(i) 4 who shall represent the aquaculture
industry;

(ii) 1 who shall represent seafood packers;

(iii) 1 who shall represent licensed Maryland
seafood harvesters;

(iv) 1 who shall represent the wholesale and
retail seafood industry;

(v) 1 who shall represent the agricultural
industry;

(vi) 1 who shall represent seafood consumers;

(vii) 1 who shall represent the scientific
community;

(viii) 1 member of the Tidal Fisheries Advisory
Commission; and

(ix) 1 member of the Boat Act Advisory
Commission.

(d) Except as otherwise provided BY LAW OR BY REGULATIONS
ADOPTED BY THE DEPARTMENT [in this subtitle], all provisions of
this title and regulations adopted under this title applicable to
the taking, possession, sale, and transport of [fish] FINFISH DO
NOT apply to [fish] FINFISH that are in or from aquaculture
operations IN NONTIDAL PONDS, LAKES, OR IMPOUNDMENTS.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:
