LAWS OF MARYLAND

While the former law was haphazard and inconsistent in its
terminology, an overview of the former law clearly shows that the
basic regulated activities of a hearing aid dealer are fitting
and selling hearing aids. Specific support for this new term was
found in former Art. 56, § 508(4), which defined "practice of
fitting and dealing in hearing aids". Additionally, the
provision of former Art. 56, § 509 that prohibited the sale of a
hearing aid by an unlicensed person provided express support for
the new reference to selling hearing aids. The term "fit hearing
aids", which is used in the definition of "provide hearing aid
services", is defined in § 8-101(c) of this title.

Former Art. 56, § 514(c) required licensure, without
examination, for those persons who, as of July 1, 1969, had "been
in the practice of selling hearing aids for at least 18 months".
Individuals who were licensed under this grandfather clause in
1969 have been subject to the same duties and limitations and
have had the same right to license renewal as any other licensee
under this title. The Business . Occupations Article Review
Committee decided that, given its limited and temporary
application, former Art. 56, § 514(c) should not be revised in
this article. However, based on the concern that there might be
a challenge to the legitimacy of the renewal of a license that
initially was obtained under this "grandfather" provision, the
Committee also felt that it would be ill-advised to repeal the
former subsection. The Committee, therefore, decided to transfer
the former Art. 56, § 514(c) to the Session Laws.

Former Art. 56, § 524(1), which provided the Board with the
power and duty to authorize disbursements, is deleted as
unnecessary and misleading. The disbursement of money for all of
the boards under the Department is made under the budget and
through the Department. The procedure for these disbursements is
uniform for all of the boards.
