AN ACT concerning

Shore Erosion Control Wetlands and Riparian Rights - Maintenance

and Repair of Bulkheads

FOR the purpose of providing an exemption from certain State or
local permit requirements for a person to perform certain
maintenance or repairs on certain bulkheads on the
Chesapeake Bay or its tributaries under certain conditions;
prohibiting certain units of State or local government from
requiring a person to obtain certain permits to repair or
maintain certain bulkheads; prohibiting a certain
application of this Act; providing for the application of
this Act; and generally relating to allowing a person to
perform certain maintenance and repairs on certain bulkheads
on the Chesapeake Bay or its tributaries.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

8-1009.

(A) (1) THIS SECTION APPLIES NOTWITHSTANDING ANY LAW,

ORDINANCE, OR REGULATION TO THE CONTRARY.

(2) THIS SECTION APPLIES ONLY TO A BULKHEAD ON THE
CHESAPEAKE BAY OR ITS TRIBUTARIES THAT IS IN EXISTENCE ON JULY 1,
1989.
