WILLIAM DONALD SCHAEFER, Governor Ch. 657

(I) A PERSON MAY NOT CONTINUE SOLICITING ON BEHALF OF A
CHARITABLE ORGANIZATION AFTER CANCELLATION OF THE CONTRACT
BETWEEN THE PERSON SOLICITING AND THE CHARITABLE ORGANIZATION.

(J) A PERSON MAY NOT SOLICIT OR CONTINUE SOLICITING IN
VIOLATION OF:

(1) A CEASE AND DESIST ORDER ISSUED BY THE SECRETARY
OF STATE; OR

(2) AN ORDER ISSUED BY A COURT OF COMPETENT

JURISDICTION.

(K) (J) A PERSON MAY NOT FAIL TO APPLY CONTRIBUTIONS IN A
MANNER SUBSTANTIALLY CONSISTENT WITH THE SOLICITATION FOR
CHARITABLE PURPOSES OR THE PURPOSES EXPRESSED IN THE CHARTER,
BYLAWS, OR REGISTRATION STATEMENT OF THE CHARITABLE ORGANIZATION.

(L) A PERSON MAY NOT REPEATEDLY AND WILLFULLY FAIL TO FILE
ANY DOCUMENT REQUIRED TO BE FILED UNDER THIS SUBTITLE.

(M) A PERSON MAY NOT FAIL TO MAINTAIN OR MAKE AVAILABLE
RECORDS, DOCUMENTS, OR INFORMATION REQUIRED UNDER THIS SUBTITLE.

(N) A PERSON MAY NOT FAIL TO RESPOND OR COMPLY WITHIN 30
DAYS WITH A CEASE AND DESIST ORDER ISSUED BY THE SECRETARY OF
STATE.

3-214.

(a) (1) A charitable organization, fund-raising counsel,
professional solicitor, or solicitor which [wilfully] WILLFULLY
fails to file a registration statement, report, or other
information with the Secretary of State or [wilfully] WILLFULLY
files such a statement, report, or other information which is
materially false, or otherwise [wilfully] WILLFULLY violates the
requirements of this subtitle, is guilty of a misdemeanor, and,
upon conviction, shall be fined not more than $5,000 or sentenced
to imprisonment for not more than [one] 1 year, or be both fined
and imprisoned.

(2) An officer, director, partner, or trustee of a
charitable organization, fund-raising counsel, professional
solicitor, or solicitor which is organized in corporate,
partnership, or other organizational form who causes the entity
to commit a [wilful] WILLFUL violation of this subtitle is also
guilty of a misdemeanor, and, upon conviction, is subject to the
same penalties as the entity.

(B) (1) A CHARITABLE ORGANIZATION, FUND-RAISING COUNSEL,
PROFESSIONAL SOLICITOR, OR SOLICITOR WHICH IN A GROSSLY NEGLIGENT
MANNER FAILS TO FILE A REGISTRATION STATEMENT, REPORT, OR OTHER
INFORMATION WITH THE SECRETARY OF STATE OR IN A GROSSLY NEGLIGENT
