AN ACT concerning
Charitable Solicitations - Prohibited Acts - Penalties
FOR the purpose of altering and expanding the scope of acts
prohibited in connection with certain charitable
solicitations; prohibiting certain fraudulent illegal,
deceptive, or misleading acts, practices, and uses under
certain circumstances; prohibiting the continuation of
solicitation under certain circumstances; prohibiting the
misapplication of funds under certain circumstances;
prohibiting noncompliance with certain regulatory
requirements; regulating sweepstakes used in connection with
certain charitable solicitations; requiring certain
disclosures; establishing certain enforcement procedures;
prescribing certain penalties for certain violations,
including fines and imprisonment restitution; creating
private rights of action for certain persons under certain
circumstances; making certain persons fiduciaries in certain
situations; prohibiting an officer, director, partner, or
trustee of a charitable organization from voting for the
authorization, approval, or ratification of a contract or
transaction involving a matter certain matters in which the
officer, director, partner, or trustee has a certain
interest; altering certain definitions; making stylistic
changes; making provisions of this Act severable; providing
for a delayed effective date for certain provisions of this
Act; and generally relating to charitable organizations and
solicitations by those organizations.
BY repealing and reenacting, with amendments,
Article 41 - Governor - Executive and Administrative
Departments
Section 3-201(j), 3-212, and 3-214 to be under the amended
subtitle "Subtitle 2. Charitable Organization
Solicitations"
